Major Business Settlements of the Last Decade: Top Cases MCAG Has Filed Into

Writer: MCAGMCAG

Over the past decade, MCAG has helped businesses recover millions by filing claims in some of history's largest class action settlements. These cases have tackled corporate misconduct across industries, from excessive payment processing fees to financial market manipulation and inflated healthcare costs. Many of these settlements have provided substantial compensation to businesses unfairly overcharged or harmed by anti-competitive practices.

Below, we highlight ten of the most significant settlements MCAG has filed into on behalf of its clients—along with major upcoming opportunities that could deliver significant financial recoveries.

The Most Significant Settlements MCAG Has Helped Clients Recover From (Last 10 Years)

The Deepwater Horizon oil spill, one of the worst environmental disasters in history, caused massive economic losses for Gulf Coast businesses, with the settlement providing compensation for lost revenue, property damage, and business interruption to thousands of affected companies.

  • Visa/MasterCard-$5.4B

This historic antitrust settlement addressed alleged unfair interchange fees imposed by credit card giants Visa and MasterCard. Businesses that accepted card payments could receive significant compensation for years of excessive processing fees.

  • FOREX-$2.3B

Major banks allegedly manipulated the foreign exchange market, impacting businesses engaged in international trade. The settlement provided financial compensation to those harmed by artificial price fixing and collusion in the currency markets.

  • BCBS Subscriber-$2.67B

Blue Cross Blue Shield was accused of restricting competition and artificially inflating healthcare costs. This settlement compensated businesses that purchased health insurance, helping offset years of overcharges.

  • Auto Fleets-$1.2B

  • LIBOR Over the Counter (“OTC”) Settlements-$898M

  • Cathode Ray Tube (CRT) Indirect Purchaser Settlements-$685.4M

  • Sutter Health-$575M

Sutter Health was accused of engaging in anti-competitive behavior that drove up healthcare costs in California. The settlement provided restitution to businesses and insurers burdened by excessive medical expenses.

  • EpiPen-$540M

Pharmaceutical companies allegedly inflated the price of life-saving EpiPens, leading to major financial strain on businesses providing them to employees. This settlement helped offset the cost increases.

  • ISDAfix-$504.5M

A group of financial firms and banks allegedly conspired with ICAP Capital Markets LLC to manipulate the ISDAfix benchmark between 2006 and 2014, distorting swap and options rates for their own financial gain. The settlements provided compensation to companies with interest rate swaps affected by benchmark manipulation.

Upcoming Major Settlements

While the above settlements represent some of the largest in history, more significant opportunities are on the horizon. MCAG is preparing to file claims for its clients in several high-value settlements, including:

  • BCBS Provider-$2.8B

The largest antitrust settlement in healthcare industry history, this case follows the BCBS Subscriber settlement, which compensated businesses for inflated healthcare costs. This related settlement addresses allegations that Blue Cross Blue Shield engaged in anti-competitive practices affecting healthcare providers.

  • Discover Merchant-Up to $1.2B

Merchants accepting Discover cards may be eligible for compensation due to alleged misclassification of cards, which led to inflated processing fees.

  • Acute Care Hospital Opioids Settlement-$651M

Hospitals that treated opioid-affected patients will receive compensation for the financial burden caused by the opioid epidemic.

These upcoming settlements are set to be among the largest MCAG has ever filed into, ensuring businesses recover funds they are rightfully owed. As MCAG continues to advocate for businesses in class action claims, we remain committed to maximizing recovery opportunities for our clients.
